Signing an agency representation contract marks a professional milestone, but talent must understand the legal obligations before signing. The standard contract outlines geographic exclusivity, commission structures, payout schedules, and termination rights.
Commission rates in commercial markets follow predictable patterns. Union theatrical bookings under SAG-AFTRA rules are typically capped at a 10% agency commission. Non-union commercial work, corporate narration, industrial videos, and print campaigns usually carry agency commissions between 15% and 20%. For print modeling, agencies also routinely bill the client an additional 20% agency service fee on top of the model's gross rate.
Exclusivity clauses require careful scrutiny. Exclusive representation agreements grant the agency sole authority to pitch you within a specified geographic territory, such as a 150-mile radius or an entire state, for specific types of work. If you book a commercial job directly through a personal contact within that market, the contract generally entitles the agency to its commission. Non-exclusive contracts offer greater freedom for talent working across multiple bordering territories, allowing artists to sign with separate representation in different markets, provided those agencies do not submit them for the same roles.
Standard termination clauses should also be checked before signing. Legitimate agreements include a release clause: if the agency fails to submit or procure auditions for an artist over a consecutive 60- to 90-day period, the artist maintains the contractual right to terminate the agreement via written notice without penalty.
